Elements of Sexual imposition
- Sexual contact with another;
- Who is not a spouse; or
- Causing someone who is not a spouse, to engage in sexual contact;
- With knowledge or reckless disregard to the fact that the sexual contact is offensive.
Sexual imposition is distinguished from gross sexual imposition in that it does not involve force or threat of force and it is distinguished from sexual battery in that it involves contact instead of conduct.
Potential Penalties
Sexual imposition is a misdemeanor of the third degree, which carries a penalty of up to 60 days in jail and a $500 fine. After the first time, sexual imposition becomes a misdemeanor of the first degree, which carries a sentence of 180 days in jail and a maximum fine of $1,000.
